Roommate Match Idemnity & Waiver of Liability

By accepting and creating a site account, I HEREBY request and agree to participate in a ROOMMATE MATCH PROGRAM MANAGED BY THE LANESBOROUGH APARTMENTS AND ITS MANAGER, Richdale Management, Inc. (“Richdale”) TO HELP ME FIND A SUITABLE ROOMMATE IN ORDER TO LEASE AN APARTMENT located at 1819 South Braeswood Blvd., Houston, Texas (“Program”) subject to the following terms and conditions:

Waiver: In consideration of being allowed to participate in the Program, I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue Richdale Management, Inc., Lanesborough Apartments, its officers, partners, employees, agents, affiliates and subsidiaries (“Released Parties”) from liability from any and all claims including the negligence of the Released Parties, its officers, partners, employees and agents, affiliates and subsidiaries resulting in personal injury, accidents or illnesses (including death), and property loss or damage arising from, but not limited to, participation in the Program.

Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD the Released Parties HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in the Program and to reimburse the Released Parties for any such expenses incurred.

Roommate Matching Acknowledgement: I acknowledge that the roommate matching program is not 100% guaranteed and that a successful roommate match may not occur. I ALSO ACKNOWLEDGE THAT SELECTING A ROOMMATE IS AT MY SOLE DISCRETION, AND I AM COMPLETELY RESPONSIBLE FOR THE DECISION.

Release of Information. I authorize Richdale to request and obtain BACKGROUND INFORMATION from any school, residential management agent, employer, law enforcement agency, individual, and any other entity, information relating to me and my activities. I authorize Richdale to provide SUCH information to the Program participants. I have been advised that any information requested and provided will be used only for official purposes by Richdale for the Program and may be disclosed to third parties as necessary in accordance with applicable laws
and regulations in fulfillment of the Program. I release any individual or organization from any and all liability for actual or alleged damages to me as a result of good faith compliance with this authorization. Assumption of Risks: I understand that the Program, and use or match under the Program thereof, may carry with it certain inherent risks. I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in the Program. I hereby assert that my participation is voluntary and that I
knowingly assume all such risks.

Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Texas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
