State Privacy Rights and Rights Request Mechanism

Depending on the visitor’s state of residence, applicable state privacy laws (including the Texas Data Privacy and Security Act and similar statutes) may grant rights to: (i) know what personal information Richdale has collected, used, disclosed, or shared; (ii) access a copy of that information; (iii) correct inaccurate information; (iv) delete personal information, subject to legal exceptions; (v) opt out of the sale of personal information or sharing for cross-context behavioral advertising; (vi) limit the use and disclosure of sensitive personal information; (vii) data portability; and (viii) appeal a denial of any of the foregoing.

To exercise these rights, visitors may submit a verifiable consumer request by emailing privacy@richdale.com or by calling 402-391-7900 and asking for the Privacy Office. Richdale will acknowledge receipt within 10 business days and respond within 45 days, subject to extensions permitted by law. Authorized agents may submit requests on a consumer’s behalf with written authorization and identity verification. Richdale will not discriminate against visitors for exercising their privacy rights.

Data Retention

Richdale retains personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide services, comply with legal, accounting, tax, or reporting obligations, resolve disputes, and enforce agreements. Retention periods vary by data category and are determined based on the nature and sensitivity of the information, potential risk of harm from unauthorized use or disclosure, the purposes for processing, and applicable legal requirements. Personal information is securely deleted, anonymized, or returned when no longer required.

International Data Transfers

Richdale operates primarily in the United States. If visitors located outside the United States submit information through our website, that information will be transferred to, processed, and stored in the United States. Visitors located in the European Economic Area, United Kingdom, or Switzerland should be aware that the United States may not provide the same level of data protection as their home jurisdiction. Where required, Richdale relies on appropriate transfer mechanisms (such as Standard Contractual Clauses) for cross-border transfers.

 

Data Breach Notification

In the event of a security incident involving personal information, Richdale will provide notice to affected individuals and regulators in accordance with applicable federal and state breach notification laws and within the timeframes required thereunder.

Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction, including encryption of sensitive personal information in transit and at rest, access controls limiting access to personnel with a legitimate business need, vendor due-diligence requirements, employee training, and a written information security program maintained in accordance with applicable law (including the FTC Safeguards Rule, where applicable, and applicable state data security statutes).

However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
